Terms of Service

These Terms govern your use of Zesyl. They cover who can use the Service, what you can do with it, how connected social platforms’ rules apply, and each side’s responsibilities.
1. Agreement and eligibility
These Terms of Service (“Terms”) are a binding agreement between you and Zesyl (“Zesyl”, “we”, “us”) governing your use of the Zesyl website and application (the “Service”). By creating an account or using the Service you accept these Terms. If you use the Service on behalf of a company or client, you confirm you are authorized to bind that organization, and “you” includes it.
You must be at least 18 years old to use Zesyl. The Service is intended for business and professional use — managing social media presence for a business, brand, agency, or professional creator practice.
2. Description of the service
Zesyl provides tools to:
- publish and schedule content to social media accounts you connect on Facebook, Instagram, TikTok, X, LinkedIn, and Pinterest;
- plan content by campaign, theme, and platform;
- organize content on a visual calendar and reschedule it;
- generate content with AI — videos, images, and copy — using third-party AI providers such as Higgsfield.
The Service is currently offered in early access. Features may change, and we may add, modify, or remove functionality as the product develops. We will give reasonable notice of changes that materially reduce the Service’s core functionality for paying customers.
3. Accounts and security
You must provide accurate account information and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us at hello@zesyl.com immediately if you suspect unauthorized access.
You may only connect social media accounts that you own or are authorized to manage. Connecting an account you are not authorized to manage is a breach of these Terms.
4. Social platform compliance
When you connect a social media account, your use of that platform through Zesyl remains subject to that platform’s own terms and policies — including the Meta Terms of Service and Platform Terms, TikTok Terms of Service, X Terms of Service, LinkedIn User Agreement, and Pinterest Terms of Service. You agree to comply with the terms of every platform you connect.
If content you publish through Zesyl violates a platform’s rules, or a platform requires us to act, Zesyl may pause scheduled posts, remove content from the Service, or disconnect the affected account. We may also do so where reasonably necessary to keep Zesyl’s API access in good standing, since that access is what makes the Service work for all customers.
5. Acceptable use
You agree not to use the Service to:
- send spam or engage in platform manipulation — including bulk unsolicited posting, artificial engagement, or evading platform rate limits or enforcement;
- automate actions beyond the publishing and scheduling features the Service provides;
- publish content that is unlawful, defamatory, harassing, hateful, deceptive, or that violates the rights of others;
- publish content that infringes intellectual property rights you do not hold or have not licensed;
- interfere with or disrupt the Service, probe its security, or access it by any means other than the interfaces we provide;
- resell or provide the Service to third parties except as part of managing their social media accounts with authorization (for example, as an agency).
We may suspend or terminate accounts that breach this section.
6. AI-generated content
Zesyl’s AI tools generate drafts — videos, images, and copy — from your prompts. AI output can be inaccurate, and it is provided as a starting point, not a finished product. You are responsible for reviewing all AI-generated content before you publish it, and you are solely responsible for everything you publish through the Service, however it was created.
To the extent we hold any rights in AI output generated for you, we assign them to you on generation, subject to the terms of the underlying AI providers. You are responsible for ensuring your use of generated content complies with applicable law and the policies of the platforms you publish to, including any AI-disclosure requirements they impose.
7. Intellectual property
Your content stays yours. You retain all rights to the content you create, upload, or schedule through Zesyl. You grant us a limited, worldwide, non-exclusive license to host, store, process, and transmit that content solely to operate the Service — most importantly, to deliver your posts to the platforms you schedule them to. This license ends when the content is deleted from the Service.
The Service stays ours. Zesyl and its software, design, and branding are owned by Zesyl and protected by intellectual property laws. These Terms do not grant you any right to use the Zesyl name or branding except to truthfully describe your use of the Service.
8. Termination
You may stop using the Service and delete your account at any time from Settings → Account. We may suspend or terminate your access if you materially breach these Terms, if required by law or by a connected platform, or if we discontinue the Service (in which case we will give you reasonable notice and a way to export your content).
On account deletion, your data is removed as described in our Privacy Policy and Data Deletion Instructions. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) survive.
9. Disclaimers and limitation of liability
The Service is provided “as is” and “as available”. While we work hard to keep Zesyl reliable, we do not guarantee that the Service will be uninterrupted or error-free, or that every scheduled post will publish — social platform APIs can change, rate-limit, or fail in ways outside our control. We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose.
To the fullest extent permitted by law, Zesyl will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, audiences, or data, arising from your use of the Service. Our total liability for all claims relating to the Service in any 12-month period is limited to the greater of the amount you paid us for the Service in that period and £100.
Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by negligence.
10. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them or the Service, except where the law of your country of residence grants you mandatory consumer protections and jurisdiction that cannot be waived.
